Authorisation:- A.I.F. Ltd is an Independent Insurance Brokers acting as your agent with access to a large number of Insurers in the marketplace. The services we offer include: advising you on your insurance needs, arranging your insurance cover with Insurers and helping you with any ongoing changes you have to make. We endeavour to provide you with the best insurance cover available at the most competitive rates obtainable. A.I.F. Ltd is regulated by the Financial Services Authority (FSA), which regulates sales, advisory and service standards, to make sure those general insurance customers are treated fairly. Ltd is an independently owned company which has no direct or indirect holding in any Insurer. No Insurer has any direct or indirect holding in A.I.F. Ltd. These Terms and Conditions shall govern the contractual relationship between us and shall be deemed to prevail to the exclusion of all other terms and conditions. Any variation to these Terms and Conditions shall have no effect unless expressly agreed in writing and signed for on behalf of A.I.F. Ltd.
Contracts:- Please note that the proposal form or statement of fact where a proposal is not required is the basis of your contract with the Insurer. We are not a party to that contract and accept no liability for any breach of your contract, by you or the Insurer. It is your responsibility to provide complete and accurate information ("material facts") to Insurers when you take out your insurance policy, as well as throughout the life of your policy and when you renew your insurance. It is therefore essential to ensure that, in relation to proposal forms and all other documents all-material facts are disclosed and all details you have entered are full and accurate before signing the declaration. Please note that if you fail to disclose any material information to your Insurers this could invalidate your insurance cover and could mean that part or all of a claim may not be paid. If you are in doubt on whether to advise the Insurer of a change in circumstances that may affect the cover, then it is preferable to advise the Insurers.
Claims:- Any incidents or circumstances that might give rise to a claim must be notified to us immediately and if requested, in writing. Failure to do so could prejudice your position. We, or our appointed claims handler, will inform the Insurer without delay. You will be advised promptly of the Insurer's requirements for information necessary to establish the nature and extent of the loss. It is essential that all information supplied is accurate and complete. Where possible photos should be taken before works or repairs are undertaken.
Payment:- Insurance Premiums are payable in full before the inception of cover or as stated on our invoice. You may spread your payments through Insurers' instalment schemes or our other credit facilities. If we have not received the premium from you, we are under no obligation to pay the premium to Insurers on your behalf.
Fees & Charges:-We normally receive commission from the premium that you pay to us. We shall only withdraw commission after we have received the premium from you and in accordance with FSA regulations and agreements that we hold with Insurers. In addition to the premiums charged by Insurers, we may make charges to cover the administration of your insurance.
Replacement/duplicate certificates or cover notes and some green cards
Each and every representation of a cheque referred back by your Bank
Individual policies may be subject to an administration charge.
Mid-term adjustments may be subject to an administration charge.
The specific charge and purpose of any additional charges will always be advised to you in advance.
Commercial Clients may, in some circumstances, be subject to charges in respect of additional work carried out.
Cancellation:- Please note that many Insurers apply a minimum "Time on Risk" charge for early cancellation of cover and on some types Policy no refund of Premium is obtainable. It may be that, if you are paying on an instalment basis a balance may still be due following cancellation. When a refund of premium is due we will refund it to you immediately it is received from the Insurer.
Confidentiality:- All personal information about you will be treated as private and confidential. We will only use and disclose information we have about you in the normal course of arranging and administering your insurance with appropriate Insurers and we will not disclose any information to any parties without your consent. We may pass information about you to Credit Referencing Agencies for the purposes of arranging payments by instalments and may also pass them details of your payment record with us. Under the Data Protection Act 1998 you have the right to see personal information about you that we hold in our records.
Complaints:- It is our intention to provide you with the highest standards of customer service at all times. However, in the unlikely event of a complaint about our service, we have a formal complaints procedure. In the first instance please contact our Complaints Officer in writing at the above address. WE will acknowledge your complaint within 5 working days and give you our response to your complaint at this time if we can. If it will take more time to deal with your complaint, we will advise you who is dealing with our complaint and when you can expect to hear a fuller response. If you cannot settle your complaint with us and you are a private individual or a business with a turnover of up to £1m you may be entitled to refer it to the Financial Ombudsman Service (www.financial-ombudsman.org.uk). If you wish to pursue this course of action, at the appropriate stage in the complaints procedure, we will provide the details together with a copy of the Ombudsman leaflet.
Financial Services Compensation Scheme:- Should A.I.F. Ltd be unable to meet its liabilities then you may be entitled to compensation from the Financial Services Compensation Scheme. Details are given in your policy documentation.
Law, Jurisdiction and Third Party Rights:- This agreement which sets out the terms of our relationship with you, will be governed by the construed in accordance with English Law and any dispute arising under it shall be subject to the exclusive jurisdiction of the English Courts. Unless otherwise agreed between us in writing, no terms of this agreement is enforceable under the Contracts (Rights of Third Parties) Act 1999.
